Terms of service

General Terms and Conditions (T&C) of The Uniquora Shop

Effective: October 2026

1. Scope

These General Terms and Conditions (T&C) apply to all orders and contracts concluded between the customer and the operator of the online shop “The Uniquora Shop” (theuniquora-shop.com).

2. Contracting party

The purchase contract is concluded with:
Lehmann Uniquora / The Uniquora Shop
Chamerstrasse 174
6300 Zug, Switzerland
UID: CHE-209.272.735
Email: support@theuniquora-shop.com

3. Offer and conclusion of contract

The product presentations in the online shop do not constitute a legally binding offer but an invitation to place an order. By submitting an order, the customer makes a binding offer to conclude a purchase contract. The contract is concluded when we confirm the order by email.

4. Prices and payment terms

All prices include statutory VAT unless otherwise stated. Shipping costs are shown in the cart or at checkout before the order is completed. Payment is made using the payment methods offered in the shop (e.g. TWINT, credit card, PayPal, Klarna). Payment is due immediately upon conclusion of the contract. Products remain the property of The Uniquora Shop until paid in full.

5. Delivery, customs and import duties

Delivery is made to the shipping address provided by the customer. Unless otherwise stated, delivery usually takes 7–10 days from order confirmation.

All orders are shipped “Delivered Duty Paid” (DDP). Customs clearance, import duties and clearance fees are included in the price or shipping costs. The customer pays no additional costs on delivery.

The carrier requires the customer’s phone number for delivery and for any questions from customs authorities. It must be provided when ordering.

6. Right of withdrawal

The customer has the right to withdraw from the contract within 14 days of receiving the goods without giving reasons. To exercise the right of withdrawal, the customer must inform us by means of a clear statement (e.g. by email to support@theuniquora-shop.com). Details are set out in our withdrawal and return policy.

7. Returns

Before returning any items, the customer must contact our support team by email to receive the next steps and return instructions. The return must be shipped within 7 days of our confirmation. Products must be returned unused, undamaged and in their original packaging.

The customer bears the cost of returning items that are not defective. For defective items or items damaged in transit, we cover the return shipping costs.

Transport damage and defects must be reported within 48 hours of receipt, with clear photos, by email to support@theuniquora-shop.com.

Excluded from return are personalised or custom-made items, items used or damaged after delivery, and products subject to hygiene or safety restrictions. Exchanges for a different size, colour or variant are not possible.

Refunds are made within 7–14 business days after receipt and inspection of the return, using the original payment method.

8. Warranty

The statutory warranty provisions apply. In the event of defects, the customer is entitled to repair, replacement or a price reduction.

9. Liability

The operator is liable only for intent and gross negligence. In the event of a breach of essential contractual obligations, liability is limited to the typical, foreseeable damage under the contract.

10. Data protection

The customer’s personal data is processed only within the framework of the statutory provisions and is passed on to third parties (e.g. payment providers, shipping carriers) only to the extent necessary to process the order. Further information can be found in our privacy policy.

11. Final provisions

Swiss law applies. Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected.

12. Influencer programme

1. Scope

1.1 These terms of participation govern participation in the “Altolink Influencer Programme” (hereinafter “Programme”) of
Lehmann Uniquora / The Uniquora Shop,
Chamerstrasse 174
6300 Zug
CHE-209.272.735
(hereinafter “we”, “us” or “Shop”).

1.2 Deviating terms and conditions of influencers do not apply unless we expressly agree to them in writing.

2. Eligibility

2.1 Eligible are natural persons aged 18 or over residing in Switzerland, Germany, Austria or the USA (other countries on request), as well as companies, with an active social media presence (e.g. Instagram, TikTok, YouTube, blog, podcast).

2.2 Participation requires a successful application and acceptance by us. We reserve the right to reject applications without giving reasons.

2.3 Influencers warrant that all information provided (name, address, bank details, tax details, social media profiles) is true and complete and will be updated without delay if it changes.

3. Registration and use of the Altolink app

3.1 Participation in the Programme takes place via the “Altolink” app or the affiliate/influencer tool we use (hereinafter “App”).

3.2 Once accepted, influencers receive personal access/an account as well as individual tracking links, discount codes or other promotional materials.

3.3 Influencers must keep their login details secret and protect them from unauthorised access. Passing the account on to third parties is not permitted.

3.4 We may suspend or delete accounts if:
these terms of participation are violated,
there are attempts at manipulation or fraud, or
there has been no activity for an extended period.

4. Promotional activities and obligations of influencers

4.1 Influencers promote our products and/or our shop on their own responsibility via their channels.

4.2 In doing so, the following requirements in particular must be met:
Compliance with all applicable laws, in particular competition, copyright, trademark and data protection law.
Clear and clearly visible labelling of advertising/posts in accordance with the applicable labelling requirements (e.g. “ad”, “advertisement”, “paid partnership”).
No misleading statements, health claims or promises that we have not expressly approved.
No unlawful, discriminatory, offensive, pornographic, violence-glorifying or otherwise inadmissible content.

4.3 Influencers may not run paid ads (e.g. Facebook/Instagram ads) using our brand name, logo or protected terms without our prior written consent.

4.4 Influencers indemnify us against all third-party claims arising from a breach of these obligations or of applicable law through their content, insofar as they are responsible for the breach.

5. Remuneration and commission model

5.1 Remuneration in the Programme is usually paid as a commission for valid sales or actions (e.g. newsletter sign-ups) generated via the personal tracking link or code, as described in the App or in the individual offer.

5.2 The exact commission rate, the actions counted and any minimum amounts and tier models are set out in the conditions shown in the App or in the individual agreement.

5.3 A commission is earned exclusively for:
orders that can be clearly attributed via the personal tracking link or code,
orders that have not been cancelled, withdrawn, returned or left unpaid.

5.4 Cancelled, unpaid or returned orders do not earn a commission and may lead to a subsequent correction of commissions already shown.

5.5 Commissions are settled e.g. monthly/quarterly within 30 days after the end of the respective settlement period, depending on the agreement.

5.6 Payouts are made by bank transfer/PayPal or, depending on the agreement, to other accounts specified by the influencer. Any fees (e.g. PayPal fees) may be deducted from the payout.

5.7 Influencers are themselves responsible for the proper taxation of their income. We reserve the right to make legally required deductions (e.g. withholding taxes) where necessary.

6. Tracking, statistics and abuse

6.1 Referred sales/actions are recorded via the App’s tracking system. This tracking is decisive for calculating commission claims.

6.2 We will remedy technical faults or tracking problems to the best of our knowledge and belief. However, there is no entitlement to complete or error-free recording.

6.3 Any form of abuse is prohibited, in particular:
orders in one’s own name primarily to generate commission (self-referral), unless expressly permitted,
fake accounts, bots, click manipulation or other unfair methods.

6.4 If abuse is suspected, we may withhold commissions, suspend the account and take legal action if necessary.

7. Rights of use to content

7.1 For all content created within the Programme (e.g. photos, videos, texts, stories, reels, blog posts) that shows our products/brand and is provided to us for use, influencers grant us a simple right of use unlimited in time and territory, unless otherwise agreed.

7.2 This right of use includes in particular:
use on our own social media channels, our website and in newsletters,
editing (e.g. cropping, subtitles) while respecting personal rights,
use for online marketing and advertising purposes.

7.3 Where necessary, influencers ensure that all rights required for use (e.g. from photographers, models, music rights holders) have been obtained.

8. Term and termination

8.1 The Programme runs for an indefinite period.

8.2 Both influencers and we may terminate participation in the Programme at any time without giving reasons with immediate effect. Notice by email or via the App is sufficient.

8.3 Commission claims that have arisen but not yet been settled at the time of termination will be paid out in accordance with the applicable settlement terms, provided there has been no breach of these terms of participation.

8.4 In the event of serious breaches (e.g. fraud, unlawful content, trademark infringements), we may suspend the account without notice and refuse to pay commissions related to the breach.

9. Liability

9.1 We are liable without limitation for intent and gross negligence.

9.2 In the case of slight negligence, we are liable only for damage resulting from injury to life, body or health and for damage resulting from the breach of an essential contractual obligation (cardinal obligation). In this case, our liability is limited to the damage foreseeable at the time the contract was concluded and typically occurring.

9.3 Any further liability is excluded. Mandatory statutory liability provisions remain unaffected.

10. Data protection

10.1 We process influencers’ personal data within the Programme in accordance with our privacy policy, available at: https://theuniquora-shop.com/policies/privacy-policy.

10.2 When using their own tracking tools, newsletters or other data collection, influencers must comply with applicable data protection laws (e.g. GDPR) and obtain any necessary consents.

11. Changes to the Programme and the terms of participation

11.1 We reserve the right to change, restrict or discontinue the Programme or these terms of participation at any time.

11.2 Influencers will be informed of material changes to the terms of participation in an appropriate form (e.g. by email or in the App). If the influencer continues to participate after the changes take effect, the new terms are deemed accepted.

12. Final provisions

12.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

12.2 If the influencer is a merchant or a legal entity under public law, the place of jurisdiction for all disputes arising from or in connection with these terms of participation is Zug.

12.3 Should individual provisions of these terms of participation be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
